Federal judge rules surveillance program unconstitutional

DETROIT (AP) - A federal judge in Detroit ruled today that the Bush Administration's warrantless wiretapping program is unconstitutional and ordered an immediate halt to it.

U.S. District Judge Anna Diggs Taylor became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy.

The case was brought by the American Civil Liberties Union against the National Security Agency. The ACLU had argued that the domestic surveillance program violates the rights to free speech and privacy.

The government argued that the program is well within the president's authority, but said proving that would require revealing state secrets.

The Republican whine.....the judge is a Carter appointee and a Democrat. So, was the Constitution written by a Democrat too? Why are the Republicans so very intent upon hearing our private phone calls? They haven't caught any terrorists using these illegal powers of invasion of privacy. GASP....a black Democratic female judge...that's grounds for impeachment as far as wingers are concerned.
It's "Just one district judge"...per CNN "analyst", Jeffrey Toobin..."now the law of the land", he said with disappointment, but "the Bush administration will appeal" and he's sure the wiretapping is continuing while their lawyers respond. Incredibly, instead of defending our rights to privacy, CNN is defending the Bush spies and their "secret" information. Why does CNN do nothing but present the administration's case for them? Instead of applauding a judge's decision that protects OUR RIGHTS, CNN is questioning why the decision was even made public. A "hotly contested political issue" said CNN...instead of a hotly contested violation of our civil liberties.

Update:Tony Snow said the Bush administration "couldn't disagree more with this ruling."

DETROIT - A federal judge ruled Thursday that the government’s warrantless wiretapping program is unconstitutional and ordered an immediate halt to it.

U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy.

“Plaintiffs have prevailed, and the public interest is clear, in this matter. It is the upholding of our Constitution,” Taylor wrote in her 43-page opinion.
